Police and Criminal Evidence Act 1984 - practical training for Non Police Prosecuting Agencies- Although not initially intended to apply to NPPA’s, a proliferation in their enforcement, investigation and prosecution responsibilities has meant that they have to abide by the spirit, if they are unable to abide by the letter of this legislation. The Police and Criminal Evidence Act 1984 (PACE) creates a legislative framework for all organizations with a responsibility to conduct criminal investigations as well as providing codes of practice for the exercise of those powers. The aim of PACE has always been to establish a balance between the powers of the investigator and the rights of members of the public and this applies equally to NPPA’s as it does to the Police.


However, there are significant aspects of this legislation which will simply not apply to NPPA investigations and so this is not covered in this training presentation. Rather, it concentrates on two relevant areas – the ‘caution’ and ‘interviews under caution’ and provides officers with detailed knowledge of how and when PACE will apply, how to conduct interviews under caution and who may be present. Most investigations are extremely labour intensive – it would not be a good place to be if evidence obtained as a result of a great deal of hard work is deemed to be inadmissible for want of following the correct procedure. Equally, enforcement officers, as well as investigators, need to know the ramifications of S.78 of the Act and to ensure that their evidence is obtained fairly.
